Elaway AS is committed to process your personal data in an open and lawful manner that safeguards your privacy. Personal data are any information that can be linked to a natural person.

This privacy notice gives you further information about how we collect, use and protect personal data, and what rights you have in this regard.

Elaway AS is the data controller for personal information we use in connection with your purchase of our charging services for electric cars, for example for contact persons in housing cooperatives/condominiums and our end customers of our services. We are also the data controller for the processing of personal data in connection with newsletters and cookies on elaway.io.

Elaway AS is also the data controller for the processing of personal data about users of the app we offer. You can read the Elaway App Terms of Use when you download the app.

WHO DO WE PROCESS PERSONAL DATA ABOUT?

We process personal data about the following persons:

Potential and existing end customers, typically residents of housing cooperatives and other private individuals who purchase services from us

Contact persons and other employees in businesses such as housing cooperatives, condominiums, installers and suppliers and other partners.

Recipients of our newsletters, for example, if you have agreed to receive our newsletter or have an existing customer relationship with us.

Visitors to elaway.io (see cookie notice)

Users of the Elaway app, which are the apps we offer for you to manage the charging services and get an overview of charging sessions and costs.

FROM WHAT SOURCES DO WE COLLECT PERSONAL DATA?

We process personal data that we receive from you. For example, if you are a resident of a housing cooperative, condominium, etc. who has an agreement of charging stations from us, we will be able to receive contact information about you from the housing cooperative, to administer the agreement and be able to offer you services.

PURPOSE AND LEGAL BASIS FOR OUR PROCESSING OF PERSONAL DATA

We process your personal data for the following purposes:

Provision of services and app. In order for us to provide services to you, we need, among other things, contact information such as name, address, e-mail address and information about housing cooperatives/condominiums. We also need payment information, such as credit card information, bank account number and payment status as well as information about your use of the service, including electricity consumption. If you use our apps, we will also process information about your charging location, time of charging, charging time and power consumption. Our legal basis for processing in these cases is our agreement with you or because we have a legitimate interest in processing the personal data in order to optimize our services.

Communicating with you. In connection with contact and communication between you and Elaway, we will process your contact details and the content of the communication. This personal data may, for example, be call history, questions, etc., and is processed either to fulfil an agreement with you or because we have a legitimate interest in handling inquiries that come to us.

Marketing and newsletters. We may contact you directly for marketing purposes. This can happen through telephone contact, but typically by e-mail or SMS. The reason for processing in these cases is our legitimate interest in marketing our services or your consent.

We offer the possibility to subscribe to our newsletter to reach potential customers and to keep existing customers updated. When you sign up for our newsletter, you consent to the processing of personal data about you. You can withdraw your consent at any time. You can either do this by sending us an email or clicking on "Unsubscribe" at the bottom of the email.

Development and analysis. We use data about how you use our services and websites to understand customer needs. This includes, among other things, usage patterns (charging time, power consumption and time of charging), duration of the customer relationship, place of residence and age. We carry out these processing activities on the basis of our legitimate interest in improving the product range and offers.

Compliance with laws and terms of use. We process personal data in connection with bookkeeping/accounting and reporting to public authorities in order to comply with our legal obligations and to comply with court orders or requests from public authorities. In certain cases, we may also use information about how you use our websites and apps to prevent or detect fraud, abuse, illegal use and violations of our terms of use.

WHO DO WE SHARE YOUR PERSONAL DATA WITH?

In principle, we will not share personal data with other parties other than subcontractors, unless otherwise stated in this privacy notice or we have a legal obligation to do so (e.g. tax authorities, courts or other public authorities to the extent required by law). If we use suppliers who process personal data on our behalf, we will always ensure that we enter into data processing agreements that safeguard privacy. For example, we share personal data with providers of the payment service Stripe. These providers may also process your personal data for their own purposes and therefore have their own privacy notices which you can read online.

TRANSFER OF PERSONAL DATA TO COUNTRIES OUTSIDE THE EU/EEA

To the extent that your personal data is transferred to countries outside the EU/EEA, we will ensure that your personal data is subject to an adequate level of protection. We use a global customer relationship management system (CRM) supplier to handle customer data. Although all customer data is stored on data centres located within the EU/EEA, personal data may be transferred to a limited extent to countries outside the EU/EEA if we receive support outside the EU/EEA. Our supplier uses the European Commission's standard contractual clauses (SCCs) as a transfer mechanism. HOW LONG DO WE KEEP OR STORE PERSONAL DATA ABOUT YOU?

We delete personal data when it is no longer necessary to process it for the purpose for which it was collected unless we are required to store the data by law or regulation. For example, we will need to store billing information in accordance with bookkeeping legislation.

WHAT ARE YOUR RIGHTS?

If we process personal data about you, you have the following rights:

Access to information. You have the right to request confirmation of whether we process personal data about you and request access to our processing of your personal data.

Rectification. You can ask us to correct or supplement information about you that is misleading or incorrect.

Erasure (the right to be forgotten). You may in certain cases ask us to delete your personal data.

Restriction. You may in certain cases ask us to restrict the processing of your personal data.

Data portability. You may receive the personal data that you have provided to you or others in a structured, commonly used and machine-readable format if the basis for processing is consent or agreement.

Objection. You can object to our processing of your personal data.
